Conditions of Use

Accepting and executing orders

1. The on-line store @@@@@@@, hereinafter referred to as the Store, runs the business activity consisting in selling goods via the Internet.
2. Information about the Store's current offer are available at @@@@@@@@@@. The Store makes every effort to ensure that the pictures and descriptions of goods presented therein are consistent with their actual characteristics. Due to limited capabilities of providing the customers with factual colours via the Internet, the colours of materials presented therein shall be regarded as approximate only.
3. Customers can place their orders by filling the order form available at @@@. As soon as the Customer places the order, he/she is sent a notification e-mail with the order details.
4. Acceptance of the order to be executed:
     1. in the case of orders to be settled by transfer, the order execution starts once the amount due has been fixed on the account
     2. in the case of orders to be settled via COD, the order execution starts once the Customer's order has been received by the Store,
     3. in the case of orders to be settled via the credit card payment, the order execution starts once the Customer's card has been successfully authorized.
5. The order execution is subject to the good's availability. Shall the goods included in the order
6. Shall the goods included in the order be unavailable and sole order item \, the Store reserves itself the right to unilateral cancellation of the order, of which the Customer shall be notified in a separate e-mail.
7. Each order is provided with a relevant VAT invoice. VAT invoice is issued once all the goods mentioned in the order are completed and ready to shipment.
8. The Customer can introduce changes to the order until the issuance of the VAT invoice. The Customer can cancel the placed order in full until the moment of the shipment thereof. The above changes can be introduced upon contacting the Customer Service Centre via the e-mail sent to @@@@@@@.
9. By placing the order in the online Store, the Customer agrees to record his/her personal data in the @@@@@ Store database and to process for the purposes of the contract execution. Providing personal data by the Customer and granting the consent for processing thereof is necessary for the Store's successful execution of the order. The Customer shall be held responsible for providing untrue or wrong personal data.
10. Personal data are protected in line with the provisions set forth in the Law on Personal Data Protection dated 29.08.1997 (O. J. No 133 item 883) so that the access of third persons thereto is excluded.

Prices of goods

1. All prices of goods are provided in Polish PLN and are gross prices.
2. Price per each good is binding as of the moment of placing the order by the Customer.
3. The Store reserves itself the right to introduce changes to the goods' prices being available in the Store stock, to introduce new offerings to the Store portfolio, to conduct and cancel promotional activities on the Store's websites or to introduce changes thereto.
4. The goods delivery shall be organized in the manner chosen by the Customer and specified in the order.
5. The costs of delivery depend on the chosen manner of delivery.

Order execution term

1. Orders are executed within 7 days. Average execution term is 2 business days. Shall the order execution term be prolonged beyond 5 business days, the Customer shall be informed thereof by means of e-mail or telephone.
2. Date of delivery = execution period + estimated delivery term
     1. Manners and terms of delivery in Poland:
          1. Courier, estimated delivery term 1 day
     2. Manners and terms of delivery within EU:
          1. Courier services, 3-5 business days
          2. Polish Post priority mail, estimated delivery term 7 business days
     3. Manners and terms of delivery outside EU:
          1. Polish Post economical mail, estimated delivery term 2 - 8 weeks
          2. Polish Post priority mail, estimated delivery term 1 - 2 weeks
          3. Polish Post courier mail POCZTEX, estimated delivery term 2 - 4 business days
3. The Store shall not be held responsible for non-delivery or delayed delivery of the goods being due to incorrect or not precise delivery address provided by the Customer.

Forms of payment

1. The Customer can choose from the following forms of payment for the delivery within the territory of Poland:
     1. cash on delivery: payment to the postman or courier
     2. payment by credit card
     3. payment via the bank transfer to the Store's account
2. The Customer can choose from the following forms of payment for the ordered goods for the delivery outside the territory of Poland:
     1. payment by credit card
     2. payment via the bank transfer to the Store's account

Complaints

1. The Customer is entitled to lodge a complaint against the Store in the case the delivered goods were identified as having:
     1. manufacturing defects,
     2. mechanical damages due to incorrect transportation
     3. inconsistency of delivered goods with goods defined in the order
2. The Customer is authorized to check the condition and content of the delivery package in the presence of the courier upon the delivery. Once the Customer accepts the delivery (i.e. he/she signs the delivery receipt with no objections) any and all possible claims towards the Store with regard the good's identified fault ( loss or damage to the delivery content) are no longer valid and grounded.
3. The basis for complaint about the damaged delivery are simultaneous:
     1. drawing the loss protocol in the presence of the courier upon the delivery
     2. notifying the Store about the situation
4. In order to proceed with the complaint, the Customer shall send the delivered goods back to the Store's address: @@@@@@@ @@@@@@@
5. The complaints shall be considered within 14 days upon the Store's receipt of the delivery with faulty goods at the latest.
6. Shall the complaint become recognized as grounded, the damaged goods shall be repaired or replaced with a new one, of full value as the original one,; shall this turn to be no longer possible (for example due to lack of stock), the Store shall reimburse the equivalent of the goods' price to the Customer or offer him/her other goods available at the Store.
7. Shall the complaint be rejected; the Seller shall return the goods to the Customer with written justification of the decision only upon the Buyer's settlement of return shipment costs.
8. The differences in the appearance of goods delivered and those specified in the order, visible on the website @@@@@ shall not be regarded as grounds for lodging a complaint, since such differences may result from the different settings (parameters) of the Customer's screen.

Right to withdraw from the contract

1. In line with the provisions of the Law dated 2nd March 2002 on "about the protection of some consumer rights and liability for product dangerous for economic insurance", the Customer can resign from the product purchased at the Store without being obliged to state the reasons thereof within 10 days upon the goods delivery.
2. The goods being returned cannot be damaged, bear the signs of exploitations, and be packed in original, complete packaging.
3. The goods being returned shall be sent back together with the received purchase receipt.
4. The Store commits itself to reimburse the amount being equivalent to the goods' price. The money shall be sent back within 5 business days via the bank transfer to the account specified by the Customer. The Store does not accept any deliveries sent back upon the cash on delivery. The cost of sending the goods back shall not be subject to reimbursement.

Final provisions

1. The sales contract is entered into by the Customer and @@@@@@@@@. The recording, protection and rendering the essential provisions hereof available takes place by printing and delivering the VAT invoice to the Customer together with the goods.
2. The court proper to the settlement of any and all disputes resulting from the sales contracts shall be the court proper to the registered seat of the defendant or to the place of the order execution.
3. In any and all disputes not regulated by this rules and regulations the rules of the Civil Code shall be applicable, as well as the provisions of the Law on special conditions of customer sales and amendments to the Civil code and the provisions of the Law on the protection of some consumer rights and liability for damages caused by a dangerous product.
4. This Rules and Regulations enters into force as of @@@@
5. The Customer commits himself/herself to read carefully the contents of this document and he/she is fully bound by the provisions hereof each time while placing the order.
6. The Store reserves itself the right to introduce the changes hereto. The Store Customers shall be duly informed about any changes to the Store' rules and regulations. Any and all changes hereto become valid as of the date of publishing them on @@@@@
